What is it about?

This privacy policy fulfills the legal requirements for transparency in the processing of personal data. This is any information relating to an identified or identifiable natural person. This includes, for example, information such as your name, age, address, telephone number, date of birth, email address, IP address or user behavior when visiting a website. Information for which we cannot (or only with disproportionate effort) establish a connection to your person, e.g. through anonymization, is not personal data. The processing of personal data (e.g. the collection, retrieval, use, storage or transmission) always requires a legal basis and a defined purpose.

Stored personal data will be deleted as soon as the purpose of the processing has been achieved and there are no legitimate reasons for further storage of the data. We will inform you about the specific storage periods or criteria for storage in the individual processing operations. Irrespective of this, we store your personal data in individual cases for the assertion, exercise or defense of legal claims and in the event of statutory retention obligations.

Who receives my data?

We only pass on your personal data that we process on our website to third parties if this is necessary for the fulfillment of the purposes and is covered by the legal basis (e.g. consent or protection of legitimate interests) in individual cases. Furthermore, in individual cases, we disclose personal data to third parties if this serves the assertion, exercise or defense of legal claims. Possible recipients may then be, for example, law enforcement authorities, lawyers, auditors, courts, etc.

Insofar as we use service providers for the operation of our website who process personal data on our behalf as part of order processing in accordance with Art. 28 GDPR, they may be recipients of your personal data. You can find more information on the use of processors and web services in the overview of the individual processing operations.

With the help of cookies, we can make our website more user-friendly and effective for you, for example by tracking your use of our website and determining your preferred settings (e.g. country and language settings). If third parties process information via cookies, they collect the information directly via your browser. Cookies do not cause any damage to your end device. They cannot execute programs or contain viruses.

CleverReach

This website uses CleverReach to send newsletters. The provider is CleverReach GmbH & Co KG, Mühlenstr. 43, 26180 Rastede, Germany. CleverReach is a service that can be used to organize and analyze the sending of newsletters. The data you enter for the purpose of receiving the newsletter (e.g. email address) is stored on CleverReach's servers in Germany or Ireland.

Our newsletters sent with CleverReach enable us to analyze the behavior of newsletter recipients. Among other things, we can analyze how many recipients have opened the newsletter message and how often which link in the newsletter was clicked on. Conversion tracking can also be used to analyze whether a predefined action (e.g. purchase of a product on this website) has taken place after clicking on the link in the newsletter. Further information on data analysis by CleverReach newsletters can be found at: https://www.cleverreach.com/de/funktionen/reporting-und-tracking/.

The data processing takes place on the basis of your consent (Art. 6 para. 1 lit. a GDPR). You can revoke this consent at any time by unsubscribing from the newsletter. The legality of the data processing operations that have already taken place remains unaffected by the revocation. If you do not want CleverReach to analyze your data, you must unsubscribe from the newsletter. We provide a link for this purpose in every newsletter message. You can also unsubscribe from the newsletter directly on the website.

The data you provide us with for the purpose of subscribing to the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter and deleted from the newsletter distribution list after you unsubscribe from the newsletter. Data stored by us for other purposes remains unaffected by this. After you unsubscribe from the newsletter distribution list, your e-mail address may be stored by us or the newsletter service provider in a blacklist to prevent future mailings. The data from the blacklist will only be used for this purpose and will not be merged with other data. This serves both your interest and our interest in complying with the legal requirements when sending newsletters (legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR). Storage in the blacklist is not limited in time.

You can object to the storage if your interests outweigh our legitimate interest. You can find more information in CleverReach's privacy policy at: https://www.cleverreach.com/de/datenschutz/.

Google DoubleClick

Type and scope of processing

We have integrated components of DoubleClick by Google on our website. DoubleClick is a Google brand under which special online marketing solutions are primarily marketed to advertising agencies and publishers. DoubleClick by Google transfers data to the DoubleClick server with every impression as well as with clicks or other activities.

Each of these data transfers triggers a cookie request to the data subject's browser. If the browser accepts this request, DoubleClick places a cookie in your browser.

DoubleClick uses a cookie ID that is required for the technical process. The cookie ID is required, for example, to display an advertisement in a browser. DoubleClick can also use the cookie ID to record which advertisements have already been displayed in a browser in order to avoid duplication. The cookie ID also enables DoubleClick to record conversions. Conversions are recorded, for example, if a user has previously been shown a DoubleClick advertisement and subsequently makes a purchase on the advertiser's website using the same Internet browser.

A DoubleClick cookie does not contain any personal data, but may contain additional campaign identifiers. A campaign identifier is used to identify the campaigns with which you have already been in contact on other websites. As part of this service, Google obtains knowledge of data that Google also uses to create commission statements. Among other things, Google can see that you have clicked on certain links on our website. In this case, your data will be passed on to the operator of DoubleClick, Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Further information and the applicable data protection provisions of DoubleClick by Google can be found at https://policies.google.com/privacy.

Purpose and legal basis

We process your data with the help of the Double-Click cookie for the purpose of optimizing and displaying advertising on the basis of your consent in accordance with Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG. You give your consent by setting the use of cookies (cookie banner/consent manager), with which you can also declare your revocation at any time with effect for the future in accordance with Art. 7 Para. 3 GDPR. The cookie is used, among other things, to place and display user-relevant advertising and to create reports on advertising campaigns or to improve them. The cookie is also used to avoid multiple displays of the same advertisement. Each time you access one of the individual pages of our website on which a DoubleClick component has been integrated, your browser is automatically prompted by the respective DoubleClick component to transmit data to Google for the purpose of online advertising and billing of commissions. There is no legal or contractual obligation to provide your data. If you do not give us your consent, you can visit our website without restriction, but not all functions may be fully available.

We intend to transfer personal data to third countries outside the European Economic Area, in particular the USA. In cases where there is no adequacy decision by the European Commission (e.g. in the USA), we have agreed other suitable guarantees with the recipients of the data within the meaning of Art. 44 et seq. GDPR have been agreed. Unless otherwise stated, these are standard contractual clauses of the EU Commission in accordance with Implementing Decision (EU) 2021/914 of June 4, 2021. You can view a copy of these standard contractual clauses at https://eur-lex.europa.eu/legal-content/DE/TXT/HTML/?uri=CELEX:32021D0914&from=DE.

GDPR, which you give via the consent in the Consent Manager (or other forms, registrations, etc.). We process your personal data in accordance with the provisions of the European General Data Protection Regulation (EU GDPR) and the German Federal Data Protection Act (BDSG), insofar as this is necessary for the decision on the establishment of an employment relationship with us. The legal basis for this is Art. 88 GDPR in conjunction with § 26 BDSG-new and, if applicable, Art. 6 para. 1 lit. b GDPR for the initiation or execution of contractual relationships. Furthermore, we may process your personal data if this is necessary to fulfill legal obligations (Art. 6 para. 1 lit. c GDPR) or to defend against legal claims asserted against us. The legal basis for this is Art. 6 para. 1 lit. f GDPR. The legitimate interest is, for example, a burden of proof in proceedings under the General Equal Treatment Act (AGG). If you give us your express consent to process personal data for specific purposes, the lawfulness of this processing is based on your consent in accordance with Art. 6 para. 1 lit. a GDPR. Consent given can be revoked at any time with effect for the future (see section 9 of this data protection information). If there is an employment relationship between you and us, we may, in accordance with Art. 88 GDPR in conjunction with Section 26 BDSG-new, further process the personal data already received from you for the purposes of the employment relationship, insofar as this is necessary for the performance or termination of the employment relationship or for the exercise or fulfillment of the rights and obligations of the representation of employees' interests arising from a law or a collective agreement, a works or service agreement (collective agreement).

Categories of personal data

We only process data that is related to your application. This may include general personal data (name, address, contact details, etc.), information on your professional qualifications and schooling, information on further professional training and any other data that you provide to us in connection with your application.

Sources of the data

We process personal data that we receive from you by post or email when you contact us or submit your application to us via job portals.

Recipient of the data

We only pass on your personal data within our company to those areas and persons who need this data to fulfill contractual and legal obligations or to implement our legitimate interest.

Your personal data is processed on our behalf on the basis of order processing contracts in accordance with Art. 28 GDPR. In these cases, we ensure that the processing of personal data is carried out in accordance with the provisions of the GDPR. The categories of recipients in this case are providers of HR management software and IT services.

Otherwise, data will only be passed on to recipients outside the company if this is permitted or required by law, if the transfer is necessary to fulfill legal obligations or if we have your consent.

Transfer to a third country

A transfer to a third country is not intended.

Duration of data storage

We store your personal data for as long as this is necessary for the decision on your application. Your personal data or application documents will be deleted a maximum of six months after the end of the application process (e.g. the announcement of the rejection decision), unless longer storage is legally required or permitted. We only store your personal data beyond this if this is required by law or in a specific case for the assertion, exercise or defense of legal claims for the duration of a legal dispute.

In the event that you have consented to your personal data being stored for a longer period, we will store it in accordance with your declaration of consent. If the application procedure is followed by an employment relationship, training relationship or internship relationship, your data will, if necessary and permissible, initially continue to be stored and then transferred to the personnel file.

Your rights

Every data subject has the right of access under Art. 15 GDPR, the right to rectification under Art. 16 GDPR, the right to erasure under Art. 17 GDPR, the right to restriction of processing under Art. 18 GDPR, the right to notification under Art. 19 GDPR and the right to data portability under Art. 20 GDPR.

In addition, you have the right to lodge a complaint with a data protection supervisory authority in accordance with Art. 77 GDPR if you believe that your personal data is being processed unlawfully. The right to lodge a complaint is without prejudice to any other administrative or judicial remedy.

If the processing of data is based on your consent, you are entitled under Art. 7 GDPR to withdraw your consent to the use of your personal data at any time. Please note that the revocation only takes effect for the future. Processing that took place before the withdrawal is not affected. Please also note that we may have to retain certain data for a certain period of time in order to comply with legal requirements (see section 8 of this data protection information).

Right of objection

Insofar as your personal data is processed in accordance with Art. 6 para. 1 lit. f GDPR to protect legitimate interests, you have the right to object to the processing of this data at any time in accordance with Art. 21 GDPR for reasons arising from your particular situation. We will then no longer process this personal data unless we can demonstrate compelling legitimate grounds for the processing. These must outweigh your interests, rights and freedoms, or the processing must serve the assertion, exercise or defense of legal claims.

You are welcome to contact us to protect your rights.

Necessity of the provision of personal data

The provision of personal data as part of the application process is neither legally nor contractually required. You are therefore not obliged to provide your personal data. However, please note that this is necessary for the decision on an application or the conclusion of a contract in relation to an employment relationship with us. If you do not provide us with any personal data, we cannot make a decision on the establishment of an employment relationship. We recommend that you only provide the personal data that is required to complete your application.

Automated decision making

Since the decision on your application is not based exclusively on automated processing, no automated decision is made in individual cases within the meaning of Art. 22 GDPR.
